Kenosha and Pleasant Prairie police officers responded to a major car accident at the corner of Green Bay Rd and Highway 50. Witnesses reported a man, woman, and small child fleeing the area, making it a hit-and-run. Kenosha and Pleasant Prairie Police officers entered the nearby Applebee’s restaurant and found a man, woman, and child that matched the description sitting at a table. The video picks up several minutes after the initial conversation between police and the family:

In the video, it appears a man is holding a small child and refuses to listen to the police’s commands. Eventually employees of the restaraunt got the baby safe and the man is taken to the ground. One Kenosha Police officer seems to strike the man several times in the head. The man begins to groan and appears to have urinated on himself.

Reached Saturday, Kenosha Police Chief Patrick Patton says that he is aware of the incident at Applebees and it’s under review. Patton said experts on use-of-force are in the process of examining the officers’ actions. The Department’s Office of Professional Standards (Internal Affairs) is also aware of the incident and are reviewing it.

The 24-year-old man from the video and his 21-year-old girlfriend were both charged by the Kenosha County DA’s office on July 21, 2023. The man was charged with resisting/obstructing and disorderly conduct. The woman received identical charges and was also charged with possession of THC. At this time, KCE is not naming the two involved people, who live together in Zion, IL.

Kenosha Police later located the actual hit-and-run suspect(s) in the nearby bathroom inside the restaraunt. We will update you when the review is completed.

  1. Before the inevitable comparisons are drawn, the initial report indicates that, unlike the Jacob Blake case, the police did not have a warrant here and, in fact, got the wrong guy. We’ll see how this plays out. I have many unanswered questions. Can’t wait for more facts.

    1. Do you actually believe that the police need a warrant to go into a restaurant and look for someone who ran away from a hit-and-run accident? I can just imagine if the cops came to your house for breaking and entry and someone ran out the back door and into McDonald’s. You’d be okay with the cops breaking off the chase and zooming off to find a judge who’d sign a warrant, or them just standing outside the McDonald’s saying, I hope this doesn’t turn into a hostage situation but we can’t go in there without a warrant even though people are walking past us and going in for a burger. Looks like there’s going to be plenty of blame on both sides, but the money will come from the deep pockets, the taxpayers. If you know you’re innocent, there’s no law saying you can simply ignore an officers lawful commands because you know you didn’t do it. Unfortunate as the whole situation turned into, it didn’t have to go down that way but we have perpetuated lies, Miss truths and simple ignorance regarding what you do and don’t have to do when a cop asks you your name or even temporarily restrains you until they can determine whether or not you pose a danger.

      1. hahahah, i’m sure YOU’D be okay if the cops came to your house for breaking and entry and beat the living crap out of you and then charged you with resisting arrest. You’d be FINE with that as they dragged you out while the criminal was hiding in your bathroom.

        18
        1
  2. Impossible. All of the experts on Facebook that seen the video only claim he was innocent. Forget the fact they had drugs and a hit and run. Idiots

    6
    38
    1. The article says that the perpetrators of the hit and run were caught elsewhere. Early information indicates that this couple and their child were merely dining at a restaurant. The cops had the wrong guy. The woman having marijuana, while illegal in Wisconsin, isn’t exactly a major drug bust.
Also, what are you referring to as “impossible”?
I’m staying tuned to the Eye for more details. This must have been a shock to these people. One minute, they’re eating at a below-average restaurant. The next minute, a cop is literally beating the piss out of a guy, at least according to the story. Another minute later, they’re being thrown in the slammer.

      47
    2. You dumb fuck read the entire article. The ACTUALLL SUSPECTS Were located later in the bathroom so they both had every right to resist arrest because they weren’t supposed to be going to jail but hey thank god they didn’t die and they will get paid. Goofy!

      1. To be fair, that part was wedged between two big ads, so is easily overlooked, but yeah, I can understand why the guy got got the snot beaten out of him might have been defensive to the cops. I mean, I would be pretty irritated if I’m having dinner with friends or family, and some cop come up to me claiming I ran off from an accident. What I want to know, is how specific the description was. I mean, did clothes unfortunately match, or was it ‘man woman child’?

        11
        1
        1. We don’t know that the description was ‘black male female & child’, except we all know the description was ‘black male female and child.’ Cops only need the thinnest of legal excuses to attack the public. Or none at all, right, Mississippi?

          10
          2
      2. No, they did NOT have the right to resist and not comply with the officers. And what kind of a man hides behind an infant???? I swear some people do this crap (ignore the police, do not try to comply, and work out the issue) just so they can sue later.

        1. So if you’re eating at Applebee’s just enjoy some mozzarella sticks and sliders when some cops come bum rushing in there you would have no problem getting down on the floor because you’re such a fan of cops. Yeah F that man.

    3. Dumb b*tch, drugs that are legal in his state and HE DID NOT DO IT IDIOT. Weed or not, he didn’t commit the crime they we’re apprehending him for. THE REAL SUSPECTS WERE CAUGHT, keep reading dummie.

    4. He didn’t commit the hit and run. And she had a little pot. He did not have drugs.
He didn’t resist arrest as he didn’t commit a crime. Cops screw up to, just like every profession.

    5. You must be the idiot! Do you know how to read? It was the wrong couple. They didn’t have the right to search her to find drugs because they broke their constitutional rights!

  3. Poor guys was just seeing shorty for the first time since he left for a pack of smokes.

I quit going to Applebee’s years ago. Diversity has turned it into a shithole like nearly everything else it touches.

Some DA with a last name ending in berg, feld, field, baum or just cohen will get this guy his slap on the wrist.

He’ll probably get a big settlement but the dude beating his face in looked a little south of the border so maybe he won’t get as much as if it was an Adamaic pure blood dishing out that can of whoop ass.

  5. There is some good news out of this incident.

1). The guy who was beat was an adult and not a little middle school girl.

2). The cop did not kneel on his neck for 20 seconds or so like they did to that girl at Lincoln Middle School.

    THINK POSITIVE!

    8
    7
    1. I am sure that little 130 pound girl at the middle school was well behaved, has two parents in the house hold, and listened to the officers commands.

      13
      3
      1. It is amazing that people like you defend what’s that officer did to that girl at Lincoln Middle School. It just shows that you lack basic empathy. Would you accept anyone doing that to your child? Why then, defend someone doing it to someone else’s child.

        9
        9
        1. Would you condone what she did to put herself in that situation? My child is smarter than her at 10, and knows to not behave like a feral animal at school.

          8
          2
          1. Quite honestly, it does not matter what she did. Professionals who work with children must still conform to a standard of care when they deal with a student’s bad behavior. That standard of care does not include kneeling onthe student’s neck for an extended period of time. Just because the child was acting like a child does not make it ok to kneel on her neck. There is no way to justify that behavior from a trained professional officer.

            2
            1
    2. Good comment….not, you fucktard.

The Lincoln thing was totally different and that girl got what she deserved. Completely different than this cop being a dipshit and then doing it to the wrong guy.

      7
      4
      1. Wow! You are a completely sick person. “. . .that girl got what she deserved.” Really? There is a special place in Hell for people like you who think it is ok for an officer to kneel on the neck of anyone, let alone a middle school girl. Or is that ok only if the middle school girl is black? The racism is strong with you.

        4

  6. “Oh officer, I wasn’t in an accident. This key is for my car which is in the lot. Let me put down the baby and let’s go out to the parking lot and I’ll show you. I’m not some monster who’s going to use a baby as a shield.”

    15
    3
    1. The baby was holding on too his shoulder if you watch the video most of you must be bots because I’m sure human beings aren’t this stupid if someone is tackling you with your child we would you drop the toddler or hold the child to protect it common freaking sense that most of these people on this thread doesn’t have.

  7. After the accident , a man , women and small child were seen fleeing the scene. Police find people matching the people that were fleeing ( probable cause) . During the video the couple in question do not respond to officers command . Thus becoming a law breaking matter . Please read all the material and watch the video.

Word to all of the arm chair socalist. You got to be tough if your gonna be stupid .

    11
    11
    1. I swear yall are some of dumbest people on earth…
You’re at the mall with your family and police just jump on you out of the blue. You’re cooperating?

      13
      11
  8. If you’re resisting arrest and using a tiny baby to shield yourself from the police, you should get punched in the head. But the colors involved here match the needed narrative so here we go.

    12
    9
  9. Seems pretty simple, Drop the charges, public apology. Both sides were wrong. Why do people resist police is behind me. Not sure if punching in head is in the playbook. Some disciplinary action seems warranted.

    4
    4
  10. In typical DEMOCRAT fashion, the community agitators are crying over the police using force against an ADULT male (not a man) using a baby as a shield!! Men, don’t use babies as shields.

    11
    5
  11. Re: the crime of resisting, at trial the state would have to prove, beyond a reasonable doubt, all elements of the crime, including that “[t]he defendant KNEW that officer was an officer acting . . . with lawful authority . . .” J.I. Crim. 1765 (emphasis added). In other words, there’s a knowledge element to this crime.

There could very well be a defense IF the defendant was merely eating in a restaurant and he was blitzed by a cop for reasons unknown to the defendant. Therefore, this case may hinge on what the officer told him before the above video started. (I’m sure every cop, including the pugilist cop, had a bodycam that will eventually be made available to the defense.)

Can’t wait to see more videos as they’re released to the public.

    12
    1. I agree with Attorney Cicchini’s cautious approach. I would emphasize that the officer must act in an official capacity and with LAWFUL AUTHORITY. Here, official capacity is not an issue, so was there lawful authority?

Under Wisconsin law, a police officer who has a reasonable and articulable suspicion (lesser standard than probable cause) that a person is committing or has committed an offense may stop and temporarily detain a person to inquire as to their identity and obtain an explanation.

Near the scene people matching the description are found in a restaurant. Arguably that’s a reasonable suspicion. Generally the temporary detention and questioning must be done in that vicinity. Because we have only seen the back end of a video we don’t know if the officers acted properly or not. We saw an escalated situation which does not fit the normal temporary detention for questioning. So what’s the rest of the story? Once we get that then we can make an informed assessment.

      6
      1
      1. Be serious, Cicchini.

It’s a fucking black eye for the department ONCE AGAIN…..regardless of what the real story is. The cops acted like assholes and these types of videos are why a lot of people do not like them.

Plus, you have to question the dipshit, moronic, fuckwad cop who got the wrong guy. It’s not like the cop was picking out a guy out of a 100,000 person stadium. He was at Applebees and I doubt there were too many black guys with red pants running around there. How do you fuck that up? How incredibly stupid.

        8
        6
        1. I agree. There are so many good cops out there that get unrecognized. Then there are completely incompetent cops that do stupid shit like this and ruin the reputations of all. Police departments need to clean house of cops like this. Instead they will get a slap on the wrist and continue costing the taxpayers money with all the lawsuits they cause.

    2. Don’t hold your breath. Cops are notorious for not releasing video. Especially when it incriminates them.

      2
      1
    3. Act like you actually practice law. All you really know how to do Is fill out a plea questionnaire. Keep it real..

      1
      4
  12. Punched 3 times in the head! That’s bullshit! You don’t punch anyone in the head wtf! When people are innocent and are being blamed for something their reactions vary. In this case a lawsuit is called for!

    5
    6
    1. No, people are guilty until proven innocent. I’ve been there and I was definitely guilty until I was innocent and some of these cocksuckers will throw the book at you to get anything to stick. Good thing the detectives at joint services aren’t a bunching of idiot thugs like some of the guys on patrol.

      3
      1
    2. Keep reminding everyone about no punching in the head like in New York City where they beat people?

  13. Noticing the advertisements. Does Merlin muffler work on car belonging to white males? Looks like they only work on cars belonging to minorities and trans white women.

I had a minority steal my catalytic converter….the irony.

  14. Why are black men who use children and babies to try to shield themselves from their irresponsibility held in such high esteem? What a sick society.

    7
    5
    1. If you had your child in your hand and someone Comes manhandling you your first instinct wouldn’t be to drop the child I’m a mother I have been in a similar situation my reaction was to hold and shield my child.

  15. Wether the guy is guilty or innocent is immaterial regarding the officer’s actions. The guy was fighting with the officer’s instead of cooperating. If he would have cooperated there wouldn’t have an incident. When are people going to understand when you don’t cooperate and start fighting you can get hurt or worse. Remember the police officers are like everyone else that works, they want to go home at the end of their shift. You cannot fault a police officer as you cannot see everything that went on. The officer should be given the benefit of the doubt. The guy was fighting with police. Cooperate no problem!

    12
    8
    1. Quite frankly he probably did cooperate but the low IQ KPD thug probably didn’t like the guy’s “attitude”. Or he declined to engage with the cop because the officer was an absolute piece of trash with no social skills. I’ve been standing in my garden watering my plants when a KPD detective just walked up to me demanding to know about my neighbors. No “hello,” no “hi my name is detective…” no “I’d appreciate your help with this issue.” Just demands.

You can’t “comply or be detained” your way into community support.

Cops are lazy and surly and lack basic courtesy these days. I can understand why. They aren’t peace officers they’re fighting a war on black and poor people Nixon started 52 years ago and they’re everyone’s daddy. But still. If you want people to “comply” at least show some basic decency and respect.

    2. YES! Just comply.
Cops do not go to work to fight or obstruct civil rights.
Rights. You have them. But that excuse is not going to work on restaurant floor. Call Jesse in the morning.
      Sorry to be blunt.
      I’m retired LE. 34 yrs.
      I’m investigating. Cooperate.
If you don’t make my work harder. Both of our lives will be easier.
      FJB.

  16. Two things can be true at once: you shouldn’t fight with police, and police shouldn’t bash you in the head 9 times AFTER they’ve already taken you down and subdued you.

    7
    2
    1. Most of the time you’re correct. But when there’s a baby being used as buffer I’m all for doing whatever that needs to be done to get that child out of harms way. If the guy snapped and ended up killing that child everyone screaming police brutality would also blame the cops for not doing enough. It’s unfortunate that it was mistaken identity but until you clear that up… you cooperate. You think the cops are just gonna go away because they come across a possible suspect that claims they didn’t do anything? Help them clear it up so they can move along. Remember this… police policy is ATM. Ask, Tell, Make. That third option is on you.

  17. worth at least two million. not one colored cop in the video. cops are thugs and are an extension of the government which is not needed and not appreciated.

    4
    8
    1. Is that one million from KPD and one million from Pleasant Prairie PD? Notice the Pleasant Prairie patch on the guys arm. Looks like he is wearing stripes so that is a supervisor.

  18. Like the song says he went applebees for bourbon street steak,an oreo shake and a beat down…just cooperate!

  19. This is absolutely fucking pathetic.

Not only was it brutality…..but it was the WRONG FUCKING GUY. Yeah, they are getting sued and they deserve to.

You know……when all this stuff with the riots, etc. started several years ago….it blurred my line between hood people and the police. You basically were on one of the two sides and I definitely more on the side of the police. However, that is where I was blurred….my attitude before (and it going to start to be again) is fuck both of them…..I wouldn’t trust either of those two sides. They both are primarily all shitheads with some good ones in there….

    4
    1
  20. Cops get the wrong guy sometimes. This guy puts his baby in danger, ignores the police and starts walking away. If the police have something wrong, you help them straighten it out. Give them your license, show them your vehicle. Even if you get wrongfully charged, you work it out in court. They can trace the vehicle back to whoever owns it.

You don’t endanger a child and scream obscenities. This guy deserves those charges.

    6
    5
  21. Great job KPD >>> FIx IT!!!! This is crazy, Cops are not the judge and jury.
this can happen to anyone; Cops don’t like when you stand up for their rights.
KPd what was wrong with a little investigation before you officers beat the hell out of someone. this needs to stop and and public needs to no . what the outcome is stop hiding everything this is not what we have police for. kpd has some great officers , But they also have alot of bad . I was pulled over for a simple mistake the police officer was a total jerk to me. Got my ticket , paid my ticket. and admitted to my simple mistake, but the officer was just trying to take it the the next level , I had to be the one to deescalate the situation for my self so i didnt wind up beat up or in hand cuffs , he even had is gloves on ready to go , for a simple 12 mph over . SORRY JUST A MISTAKE ON MY PART .

  22. IT’S FUNNY HOW I JUST SEEN A WHITE MAN IN FESTIVAL FOOD COMPLETELY TELL THE POLICE FU!K OFF AFTER THE POLICE WANTED TO TALK WITH HIM OUTSIDE HE TOLD THE POLICE HE DIDN’T WANT TO TALK AND HE WAS FU!KING BUSY MAKING A TRANSACTION. HE COMPLETED IGNORED THEY ORDER AND WAS VERY VOLATILE. THE POLICE DID NOT GET AGGRESSIVE THEY TRIED THEIR BEST TO DE ESCALTE THE SITUATION AND THE MAN KEPT THE SAME TONE THROUGHOUT THE SITUATION BUT HE WAS NOT ARRESTED FOR BEING AGGRESSIVE, YOU STUPID MFS TALKING ABOUT THIS MAN WAS USING HIS BABY AS A SHIELD WHY WOULD HE HAVE TO PUT HIS BABY DOWN FOR WHAT? MAYBE THE POLICE SHOULD OF REALIZED HE HAD A BABY IN HIS ARMS THEIR CONCERN SHOULD OF BEEN THAT THEY COULD OF HURT THE BABY. NOT ONLY DID THEY HAVE THE WRONG PERSON BUT TOOK THEM TO JAIL. YALL THINK CITIZENS DON’T HAVE RIGHTS? DON’T NOBDY HAVE TO TALK TO THE POLICE FOR WHAT? HE DIDN’T DO ANYTHING SO WHO WAS BEING VIOLATED BECAUSE SOME IDIOT MORE THAN LIKELY RACIST POINTED A BLACK COUPLE OUT. THE POLICE THINK THAT BECAUSE THEY WERE GIVEN A BADGE THEY HAVE THE POWER TO ABUSE NOT ONLY PEOPLE BUT THEIR AUTHORITY. ALOT OF THESE POLICE ARE RACIST OR EITHER JUST YOUNG WITH THE POWER TO TREAT SITUATIONS HOW THEY WANT BUT GOD HAS THE FINAL SAY! IF I WAS HIM I WOULD TEAR KPD A NEW ASSHO!E THE POLICE STATION WOULD BE BLACK OWNED.

    4
    6
    1. I hate to tell you this but the police do have the right to detain you and question you. And you need to comply with what they say if you are innocent, guilty, black or white or purple.

You put your baby down before you start walking away from police that are giving you verbal orders. The police just aren’t going to let you go. They are going to physically stop you no matter what you do. That would be why you set the baby down.

      3
      3
      1. Telling me that does not change what I said and how I feel. You know just like I do us BLACKS as you white people say are always the target and always being blamed for America fuck ups!!!

      2. He wasn’t walking away from the police he was walking to the bathroom to change his baby do you people read before you comment?

      1. Right! Also, where is the red pen option so we can fix your shitty grammar? If you want to be taken seriously, write like a person who didn’t get passed along in school because “no child left behind.”

      1. Werks? slow stupid idiot. I didn’t misspell anything you mad because I typed in Caps that’s how mad you stupid mfs make me.

  23. When you give Kenosha cops, the worst kind of scum, license to commit any crime (which is their want), this is what happens: Innocent people brutalized; innocent child cries on the dirty floor. Welcome to Kenosha, world.

    3
    5
  24. This is what you are paying for. Are you happy with your gov leaders, police, schools, hellcare. If you are no longer happy with your services, do you continue to pay? No, so stop paying extortion taxes like the guy’s from Dick’s Roofing.

  25. Just kind of wondering why this gentleman still has charges being pressed on him I would fight back too if I was innocent and didn’t do what they said I did he does not deserve to be charged with any fucking crime them cops need to be beaten themselves and I’m thrown in fucking prison with a bunch of cop haters

  26. All this shit with the cops is getting out of hand they need to start learning their place and realize they work for these are nothing but a bunch of Pirates the blue line gang that’s all they are they need to take that blue line and shove it up their fucking ass

    1
    1
  27. Kevin,

I have 2 questions for you:

    1. Why is it that the police are not releasing the name of the man who was falsely accused/beaten and the persons who actually commited the crime? Is it because that information can’t be released until the investigation is complete?

    2. If I know I did not commit a crime and the police stop to question me, what am I obliged to do? Under the law, am I required to stop and answer their questions? Or, do I have the right to refuse answering their questions and walk away? (Knowing the safest thing to do in most cases is to cooperate.)

    Thanks.

    1. I’m not sure why the police are not naming the two individuals who arrested. I also declined to name them at this point. If police have reasonable articulable suspicion that you have committed a crime are committing a crime or are about to commit a crime, they can temporarily detain you to investigate. When you are detained it is unlawful to leave the area

    2. They haven’t been named because they already are going to have to pay a pretty penny in a settlement let alone if they publicly named these people.

  28. FIRST OF ALL, WHAT WE SEE ON VIDEO IS ONLY PART OF THE EVENT. THERE IS MORE TO THE STORY. REMEMBER, THIS IS ONLY PART OF THE STORY….LIKE EGGS ARE PART OF THE CAKE…IN THIS CASE THE EGGS GOT BEATEN BUT AGAIN…VIDEO DOESN’T TELL THE ENTIRE STORY!

  29. I am wondering why the Pleasant Prairie PD supervisor that was next to the idiot beating the shit out of the man tell him or request him to stop? This is like George Floyd where cops are not doing the right thing and stand by while people are being hurt. Kevin, can you request the video from PPPDs body camera as that officer isn’t part of KPDs internal investigation of this incident?

  30. Kenosha has to stop giving the bad police officers a break and start giving them what they deserve. There’s good police officers and they are not recognized. Only the bad ones stay in the limelight.

    1
    1
  31. Saw this online. Good question.

So is there a reason why they have not named the driver of the fatal crash last week? The word is out that the 20 year old driver had two previous duis and his parents bought the alcohol they all drank. Have they been arrested? Has the driver? Do they have money?

  32. The Pleasant Prairie cop with his knee in the guy’s back is Sgt. Algiers. Why isn’t Pleasant Prairie being named in any of this? Also, why have they not yet named the officers involved with the in custody suicide? The corruption in Pleasant Prairie is out of control. John Steinbrink Jr. gets charged with embezzling tens of thousands of dollars and people get ordered not to talk about it (some paid hush money). That investigation gets referred to Racine County. A man commits suicide while in custody and the no information is released. Not even the names of the officers responsible. That investigation also gets referred to Racine County. Now a Pleasant Prairie Sergeant is involved in a wrongful arrest involving police brutality and the sergeant isn’t even named in the incident or investigation. Doesn’t anyone think that Smetana’s ties to Racine agencies are a conflict of interest for them to be investigating cases from Pleasant Prairie? Why aren’t those cases referred to Kenosha County Sheriff like other agencies in the county?
